Criminal Defense

Juvenile Defense

Juveniles fall under the same Massachusetts Rules of Criminal Procedure as adults.  The District Attorney in Massachusetts prosecutes juveniles, who are subject to arraignment, bail, conditions of pretrial release, and trial.  Your child could be committed to DYS, which is the juvenile equivalent of incarceration.  Attorney Sargent will work diligently to prevent that.

Cleark Magistrate’s Hearing

In Massachusetts, the police have the option to summon you to a Clerk Magistrate’s Hearing rather than automatically charging you in District Court or Juvenile Court.  At a Clerk Magistrate’s hearing, the Clerk Magistrate hears arguments from the police officer and the defendant, then determines if criminal charges should be issued against the defendant in District Court or juvenile in Juvenile Court.  Attorney Sargent’s goal at any Magistrate’s Hearing is to dismiss the charges before official charges are issued in Court.
